These Terms of Service ("Terms") constitute a legally binding agreement between you and WaiverFlyer ("Company," "we," "us," or "our") regarding your use of our fantasy football platform and related services.

By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our services.

2. Description of Services

WaiverFlyer provides AI-powered fantasy football analysis, including but not limited to:

  • Player rankings and projections
  • Waiver wire recommendations
  • Player comparisons and analytics
  • Fantasy football tools and utilities
  • Data visualization and reporting
  • Premium subscription features

Our services are for entertainment purposes and should not be considered as gambling advice or guaranteed predictions.

3. User Accounts and Registration

To access certain features, you must create an account by providing accurate, complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Providing accurate and up-to-date information

You must be at least 18 years old to create an account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use Policy

Your Rights

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use our services for personal, non-commercial purposes.

User Content

You retain ownership of content you submit but grant us a worldwide, royalty-free license to use, modify, and display such content in connection with our services.

6. Payment Terms and Subscriptions

Pricing and Billing

  • All fees are in US dollars and exclude applicable taxes
  • Subscription fees are billed in advance on a recurring basis
  • We may change pricing with 30 days advance notice
  • No refunds for partial months or unused portions
  • Failed payments may result in service suspension

Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds will be provided for the remaining portion of any billing period.

Free Trial

Free trials, if offered, automatically convert to paid subscriptions unless cancelled before the trial period ends.

7. Privacy and Data Protection

Your privacy is important to us. Our collection and use of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using our services, you consent to the collection, use, and sharing of your information as described in our Privacy Policy.

8. Disclaimers and Limitations

Service Disclaimers

  • Our services are provided "as is" without warranties of any kind
  • We do not guarantee the accuracy of predictions or recommendations
  • Fantasy football involves risk and skill; past performance does not guarantee future results
  • We are not responsible for decisions made based on our analysis
  • Service availability may be interrupted for maintenance or technical issues

Third-Party Content

We may display content from third parties, including NFL statistics and news. We are not responsible for the accuracy or reliability of such content.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • WaiverFlyer's total liability shall not exceed the amount you paid us in the 12 months preceding the claim
  • We shall not be liable for indirect, incidental, special, consequential, or punitive damages
  • We are not liable for losses related to fantasy football performance or gambling activities
  • We are not responsible for third-party actions or content
  • Some jurisdictions may not allow these limitations

10. Indemnification

You agree to indemnify and hold harmless WaiverFlyer from any claims, damages, losses, or expenses (including attorneys' fees) arising from:

  • Your use of our services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you submit to our platform
  • Your negligent or wrongful conduct

11. Termination

We may suspend or terminate your access to our services:

  • For violation of these Terms
  • For non-payment of fees
  • For fraudulent or illegal activity
  • At our sole discretion with or without cause
  • If required by law or legal process

Upon termination, your right to use our services ceases immediately. We may delete your account and data, though some information may be retained as required by law.

12. Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

Dispute Resolution Process

Before filing any legal action, you agree to first attempt to resolve disputes through direct communication with us at legal@waiverflyer.com.

Arbitration Agreement

Any disputes that cannot be resolved through direct communication shall be resolved through binding arbitration under the American Arbitration Association rules, except for:

  • Claims seeking injunctive relief
  • Intellectual property disputes
  • Small claims court proceedings

Class Action Waiver

You agree to resolve disputes individually and waive the right to participate in class actions or collective proceedings.

13. Force Majeure

We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including:

  • Natural disasters, acts of God
  • War, terrorism, civil unrest
  • Government actions or regulations
  • Internet or telecommunications failures
  • Pandemics or health emergencies
  • Third-party service outages

14. Updates to Terms

We may modify these Terms at any time by:

  • Providing in-app notifications

Material changes will be effective 30 days after notice. Continued use of our services constitutes acceptance of the updated Terms. If you do not agree to the changes, you must discontinue use of our services.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and WaiverFlyer regarding the use of our services and supersede all prior agreements and understandings.

18. Special Provisions for International Users

European Union Users
